TRAIND SOFTWARE LIMITED, a New Zealand company, company number 9463322, NZBN 9429054002654, operates TRAIND. In these terms, "we", "us" and "our" mean TRAIND SOFTWARE LIMITED. "You" means anyone using our mobile applications or web platform, including trainers and their clients. Together, these applications and the platform are the Service.
These terms govern your use of the Service. Please read them alongside our Privacy Policy. By using the Service, you agree to these terms. If you do not agree, you must stop using the Service.
You must be aged 16 or over to use TRAIND. If you are under 18, involve a parent or guardian where their agreement is required by applicable law.
Provide accurate account information, keep your password and sign-in codes private, and tell us promptly if you believe someone has accessed your account without permission. Use only accounts you own or are authorised to access.
TRAIND provides software for training, nutrition, health and fitness tracking, and communication. The features available to you depend on your account, device and the settings enabled by your trainer.
If you are a client, your trainer is responsible for the coaching services, programmes and advice they provide. Any separate agreement with your trainer, including their coaching fees and cancellation arrangements, remains between you and them.
If you are a trainer, you are responsible for the coaching content you provide, the client information you enter or share, and obtaining the permissions required for your use of that information. Use TRAIND within your qualifications and professional obligations.
TRAIND is not a medical device and does not diagnose, treat, cure or prevent medical conditions. Information and estimates provided by the Service do not replace advice from a qualified health professional. Seek professional advice about medical conditions, injuries, medications, dietary needs and whether a programme is suitable for you.
Food lookups, meal scans and assistant-generated suggestions can be incomplete or inaccurate. Check suggested foods, portions, nutrition values and other generated content before relying on or saving them. If you experience pain or feel unwell during exercise, stop and seek appropriate help.
Do not use TRAIND to harass, threaten or exploit anyone, promote hate or violence, share sexual or child exploitation content, send spam, disclose another person’s private information without permission, or encourage unsafe health practices. Do not upload unlawful content or content that infringes someone else’s rights.
Do not attempt to access another person’s records without permission, bypass access controls, interfere with the Service, or distribute malicious software. Follow the community and messaging rules shown in the app.
You can report concerns and block people using the safety controls where available, or contact contact@traind.xyz. We may review reported content and relevant records to investigate and respond.
You retain any ownership rights you have in the records, photos, messages and other content you submit. You give us permission to store, copy, process and display that content as needed to operate the Service and provide the features you choose, in accordance with our Privacy Policy.
Share content only if you have the necessary rights and permissions. Your trainer can access coaching records as described in the Privacy Policy. Community content is shared with the audience shown for that community.
You can choose to enable supported health integrations or assistant connections. Review the information and permissions involved before connecting. If you are a trainer, connect client information only when you are authorised to share it.
Other providers operate under their own terms and privacy policies. Revoking a connection stops future access through that connection but does not recall information already shared. Our Privacy Policy explains these connections in more detail.
Any TRAIND charges and subscription conditions must be disclosed to you before you purchase a paid service. Any additional terms presented for a paid service apply to that purchase. These terms do not introduce a fee or change an existing agreed price.
Deleting a TRAIND account does not itself cancel a separate coaching agreement. Contact your trainer about their coaching fees, refunds and cancellation arrangements.
We use reasonable care and skill in operating TRAIND. Maintenance, technical problems and updates can interrupt access, and features may change. We will give reasonable notice of material changes where practicable, including changes that affect access to a paid service.
We may update these terms. We will notify you of material changes through the Service or another appropriate channel and explain when they take effect. Changes do not remove rights or remedies you already have under applicable law.
You can stop using TRAIND at any time. You can request account and data deletion using the instructions in our Privacy Policy, without signing in.
We may restrict or suspend access where reasonably necessary to address a breach of these terms, unlawful activity or a security or safety risk. Where practicable, we will explain the reason and give you an opportunity to respond. Contact us if you believe a restriction was made in error.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under New Zealand’s Consumer Guarantees Act 1993, Fair Trading Act 1986 and the Australian Consumer Law where applicable.
These terms are governed by New Zealand law, subject to any mandatory protections and rights that apply where you live. This does not prevent you from using a court, tribunal or complaints process available to you under applicable law.
For questions, account help or complaints, email contact@traind.xyz. Tell us what happened and the outcome you are seeking so we can investigate and respond. TRAIND SOFTWARE LIMITED is responsible for operating the Service.
